Cross fined, convicted for Coke assault

A HEAVILY-PREGNANT mother has thrown a Macca’s container of Coke over a man who demanded the return of his stolen motorcycle in Cranbourne.
Amanda Cross, 32, pleaded guilty to assault over the incident in Dandenong Magistrates’ Court on 9 November.
The court heard the victim had followed his motorbike to a Cranbourne home after spotting it while driving on 30 January.
It was less than a week after the bike was stolen from his burgled Cranbourne home.
During a dispute between Cross’s partner and the victim over the bike’s return, Cross threw the drink and told him to “take the f***ing bike and go”.
Police prosecutor Senior Constable Tess Davison and Cross’s lawyer agreed that the accused and her partner did not know the bike was stolen at the time.
The rider of the stolen bike, who was now in prison, was trusted at the time by Cross and had caused a “great deal of trouble”, the lawyer said.
“The person she was with at the time wasn’t admitting it was stolen,” Cross’s lawyer said.
“A whole lot of people came out. (The victim) was quite angry … he was throwing accusations.
“It escalated. She was eight months pregnant and hormonal, and she’s thrown the Coke at him.”
Magistrate Jack Vandersteen didn’t accept that the assault was on the “lower end” of such offences, nor that Cross shouldn’t be convicted.
He took into account Cross’s previous suspended jail term for an assault causing grievous injury 10 years ago.
“It’s very arrogant behaviour by your client. He had a right to retrieve his bike.”
Cross was convicted and fined $750.
